Policies and Terms of Service
The terms of service and contract listed below was updated on August 8, 2014. This agreement supersedes all other contracted agreements (verbal or written) made by Surf New Media or its affiliates.
BILLING POLICY / CONTRACT
All billing is done in monthly cycles for site maintenance, changes, additions, search engine optimization, and other one-time and on-going services.
Site maintenance billing carries a minimum charge of 15 minutes work time.
All payments are due on receipt of invoice with a $20 administrative fee added each month to each invoice 30 or more days late.
Accounts that are late, will not be serviced by Surf New Media until FULL payment arrangements are made and/or account is brought current. A 100 percent deposit may be necessary for accounts that are continually late.
All hosting accounts must be paid in full prior to hosting activation and/or hosting renewal. Late payments will result in hosting not being activated until account is paid in full. Additional domains in addition to domains associated with the hosting account are the sole responsibility of the client. Surf New Media will seek collections for all accounts 90 or more days late. Collections fees will be added to all accounts sent to collections.
By agreeing to these terms of service, Surf New Media will perform in full the outlined services as stated in either the price quote, written contract or invoiced service agreement (such as services purchased through this website). Surf New Media will include all work associated in the outlined project and maintain the functioning of the outlined functions from the accepted price quote, written contract or invoiced service agreement should any problems occur during normal use of the site. However, Surf New Media will not be responsible for problems arising after site launch or maintenance due to changes made by third-parties, dissatisfaction with installed modules and/or abuse in site structure. Limitations of modules, the Drupal content management system, servers and other hosting-related problems are not the responsibility of Surf New Media.
Surf New Media is not responsible for user errors, client-related changes to the site structure, client-side changes to layout/design nor client-side additions, subtractions and/or changes to site modules, code or functions.
Archives: Surf New Media will work to import archives from existing websites. We require a CSV file for the archived format. We cannot guarantee the import of archives not in this format, although we will work within the limitations of the software to achieve all imports. Surf New Media is not responsible for archive formats not generated by our own programmers.
New Site Development: PER CONTRACT OR INVOICED SERVICE AGREEMENT, SURF NEW MEDIA WILL DELIVER A FULL, COMPLETE AND FUNCTIONING WEBSITE AS OUTLINED. CLIENT AGREES TO PAY ACCORDING TO THE FULL PAYMENT SCHEDULE.
Upon completion of site, ALL aspects of the website ownership is transferred in full to client WITHOUT LIMITATION. Surf New Media does not retain rights to content, files, database and/or site-related materials. Final launch of the website absolves Surf New Media of all copyright to the delivered site and fulfills Surf New Media's contractual services.
Managed Web Development: The following pertains to website orders for "Managed Web Development" (SKU: SNM-CWD) only. Purchase of this service requires a minimum of a 12 month service agreement, which starts no more than 30 days from date of purchase. The service agreement is charged each month for a minimum of 12 months to fulfill client obligation to fulfill contracted agreement. Surf New Media will provide all services outlined in the contracted web development agreement for the duration of the service agreement. Client can OPT OUT of the agreement at any time AFTER the service agreement is fulfilled. A 30-day notice is required before service agreement can be cancelled upon completion of contracted 12-month minimum client obligation.
A signed contract, deposit payment or invoiced service agreement via website order asserts you agree to pay for your website development, hosting or additional services as outlined in payment schedule and accept the terms of this contract. Failure to do so will result in non-delivery of site.
Final payment is due before site is launched and upon delivery of site. Managed web development/monthly billing begins 45 days after deposit.
Surf New Media reserves the right to take down websites for clients who are 60 or more days late with payment.
